Any teacher or principal subject to sanction has the right of appeal to an Independent Appeal Panel, appointed by the board of management, and thereafter to the courts for a judicial review. While the criteria allow for a teacher to be accompanied by up to two people, he said there is no allowance for the board to have additional representation. During court proceedings, Mr Burke had claimed that Mr Rogers had ‘lied’ in a sworn statement to the court, saying that a report by former principal Niamh McShane into the alleged breach of discipline had never been discussed by the board in Mr Burke’s absence – when the teacher said Mr Rogers had admitted to him that the discussion had taken place. A follow up affidavit from Mr Rogers, in which he sought to explain the controversy, was not admitted by the court at the injunction stage.
