Lisa Smith weeps as she gets 15 months for Islamic State membership (Irish Examiner)

Mr Justice Tony Hunt, delivering the court's verdict, said that she went to Syria with her "eyes wide open" having watched videos of Isis atrocities.

He said there was evidence that she followed rather than led but she also knew the nature of the terrorist organisation and considered its objectives. He added: "In future her focus will be her daughter, therefore the likelihood of re-offending is low." The maximum sentence for membership of a terrorist group is eight years in prison. Smith (40) from Dundalk, Co. Louth, had pleaded not guilty to membership of an unlawful terrorist group, Islamic State, between October 28, 2015, and December 1, 2019. Her lawyers asked for her to be released as they prepare an appeal against her conviction. Mr Justice Tony Hunt also refused to release her on bail.

Dundalk woman convicted in May of travelling to Syria to join the group after converting to Islam.

She accepted that she travelled to Isis-controlled Syria in 2014 but denied that she had ever joined Isis or any other group. She was convicted by the three-judge, non-jury court of membership of Isis following a trial earlier this year. Michael O’Higgins SC, for Smith, asked the court to release his client on bail pending an appeal but Mr Justice Hunt said there was no basis for a bail application and the matter is now in the hands of the Court of Appeal. He said she has been of good behaviour since returning to Ireland and there is no suggestion that she is a source of present or future danger. He added that “she may have been easily led by circumstances and other people” but she had also shown resilience and determination to join and remain with Isis “to the bitter end”. She had rejected her family and one of her husbands, who refused to swear allegiance to Isis, and had aligned herself with terrorists such as John Georgelas, an American Isis fighter and propagandist who was killed during fighting in Syria. Mr Justice Hunt also noted that she suffered domestic violence from the man she married while in Syria in 2015 and that the birth of her daughter has created a significant change in her personal circumstances.

Former Irish soldier Lisa Smith has been sentenced to 15 months in prison for being a member of the so-called Islamic State (IS) terror group.

He said the judges had accepted that life in the Syrian camps was “arduous” and the “equivalent” of being in prison, and that they had given a “substantial” discount off Smith’s sentence because of this. Michael O’Higgins SC told the court that the state of Smith’s marriage to a man, who the prosecution has claimed was a member of IS, while in Syria was “a very relevant factor in mitigation”. The judge added that she had had a “tough time in Syria” but that it was a “foreseeable consequence” of joining IS. Describing the trial as “novel”, he added: “There is no basis that she is a source of present danger.” The judge said he is satisfied that she is not likely to reoffend and that her focus is now on her daughter. He said the judges in the case had taken into consideration Smith’s previous “good character” and the fact that she had made a “positive contribution to society during her military service”.

FORMER Irish soldier and Islamic convert Lisa Smith has been jailed for 15 months for membership of ISIS.

This included her husband, Aslam, who was a fighter for the group. The court also noted there was an absence of remorse. Smith said in interview with an expert that she “wouldn't be in a hurry to run back to any Islamic State”, and that her life was “handed over” to IS propagandist Georgelas. He also said that Smith was afraid of hell and the fires of damnation and “wanted to be the best Muslim she could be". Smith was a “very damaged” and “vulnerable person” and was “looking for answers” when she came to Islam and saw it as an “attractive proposal”, Mr O’Higgins said. She had a “very difficult and hard time” in Syria before her repatriation, although this was “primarily a foreseeable consequence” of her decision to “attach herself to the Islamic State”. Smith's defence was that she travelled to IS territory as part of a religious obligation, that she did not aid the terror group, never even picked up a weapon, and was “led astray” as to what IS stood for. The court was satisfied the threshold for a prison sentence had been reached and Judge Hunt said it should not be longer than necessary to “underline the gravity of the offence” and deter others. The court noted that Smith was of previous good character, had no previous convictions and made a positive contribution to society in her military service. It was nonetheless serious for an Irish citizen and former member of the Defence Forces “to take up allegiance to a terrorist organisation” and persist with that allegiance. Judge Hunt said there was nothing beyond “justifiable suspicion” of the precise nature of Smith's activities in Syria. The court was bound to act on the facts, he said. The court determined that the case was in the lower part of the spectrum but in the upper-end of that category.

The mother-of-one was in tears as she was being led away to begin her sentence. Despite being convicted of a crime that could have seen her spend up to eight years in prison, Lisa Smith was allowed to remain on bail until today but at her sentence hearing a few weeks ago, Mr Justice Tony Hunt told her not to take any 'false comfort' from the fact she wasn’t taken into custody.

He said that her journey to Syria was in itself an act of allegiance and pointed to evidence that she swore an oath of allegiance to al-Baghdadi and that she urged her former husband to do the same and divorced him when he refused. Smith is the first person to be convicted in an Irish court of membership in another country of an Islamic terrorist organisation.

This “lovely girl” who served in the military for a decade and was remembered by the likes of former taoiseach Bertie Ahern and former minister for justice Dermot Ahern as a helpful and engaging crew member on the government jet back in the day, now a convicted member of a deranged Islamic terrorist organisation. Outside, the microphones were set up and the cameras were waiting. He acknowledged she is now the mother of a young child. When she sat down, the vibrant green tunic was obscured by the ledge, leaving just a hunched black silhouette alone in the middle of a long bench. People in the courtroom strained to hear him, but not always successfully. Lisa Smith would not be leaving by the front door this time. There was one false start when the judges appeared and the convicted woman walked towards the bench to hear her fate. But that was in a previous life. Smith (40), wearing a sage green linen tunic under that now familiar black waist-length hijab, waited for her case to come up while lawyers shuttled in and out with legal housekeeping matters. An hour later, Smith was beginning a 15-month jail sentence for membership of the terrorist organisation, Islamic State. There had been a view among some court observers that the photographers would get a second chance before the morning was out.
