Depp is refused permission to appeal against the decision at the Court Of Appeal. Following a 16-day trial in July 2021, a judge found the content of the article to be “substantially true”. Depp’s lawyers say one of the reasons they brought the case in Virginia is because the state’s anti-Slapp law is not as broad as the one in California.

On May 27, Amber shows up in court with a bruise on her right cheek and accuses Johnny of attacking her on May 21. Amber further wrote, "I never named him, rather I wrote about the price women pay for speaking out against men in power. Heard is heard telling this to Depp, attempting to downplay her outburst the previous evening, "I don't know what the motion of my actual hand was, but you're fine, I did not hurt you, I did not punch you, I was hitting you." If successful, Depp’s lawyers have said they will ask the judge, Penney Azcarate, to award $50m in damages. Depp was refused permission to appeal. Ahead of jury selection, a court order said fans of the two celebrities could not “camp on courthouse grounds” and added: “Litigants and their legal teams in this trial will not pose for pictures or sign autographs in the courthouse or on courthouse grounds.” Contravention of the order would be treated on grounds of contempt.
